LIABILITY WAIVER AND RELEASE OF CLAIMS This Waiver and Release of Liability ("Agreement") is entered into by the undersigned ("Customer") in favor of Applewood Acres Recreational Storage LLC, its owners, officers, employees, agents, contractors, successors, and assigns. 1. Acknowledgment of Risk Customer acknowledges and understands that storing recreational equipment (including but not limited to boats, trailers, RVs, ATVs, and personal property) in an outdoor environment involves inherent risks. These risks include, but are not limited to: Weather-related damage (e.g., hail, wind, snow, ice, sun exposure) Vandalism or theft Animal or insect infestation Accidental damage from other stored property or third parties Fire or flood Customer agrees to assume all such risks associated with using the Company’s storage facilities. 2. Release and WaiverCustomer, on behalf of themselves, their heirs, executors, administrators, and assigns, does hereby fully and forever release and discharge the Company from any and all liability, claims, demands, causes of action, or legal responsibility for any loss, theft, damage, or destruction to Customer's property while stored at the Company’s premises, whether caused by negligence or any other cause. 3. Indemnification Customer agrees to indemnify and hold harmless the Company from and against any and all claims, losses, liabilities, damages, or expenses (including reasonable attorney’s fees) arising from Customer’s use of the storage space, including any damage to property or personal injury caused by Customer’s actions or negligence. 4. Insurance Customer acknowledges it is their responsibility to maintain adequate insurance coverage for any property stored at the Company’s facility. The Company does not insure Customer’s property. 5. Access and Security While the Company may provide fencing, surveillance, or gates, Customer understands these measures are not guarantees of safety or security. Access to the property may be limited to certain hours, and Customer agrees to comply with all posted rules and policies. 6. Condition of Stored Property Customer affirms that all property stored is in safe working condition, free of hazardous materials, and legally owned by the Customer. 7. Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8. Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral. 9. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota
